By using the services you acknowledge that you have read and understood, and agree to be bound by these terms. You must be at least eighteen (18) years old to use the services. If you do not agree with any part of these Terms and Conditions, you must not use this Site.

Hutchison Travel Limited reserves the right, at its sole discretion, to amend the Terms and Conditions at any time by posting the amended terms on this Site. The amended terms shall be effective from and after the date that they are posted. The Terms and Conditions may not otherwise be amended.

You, the User, acknowledge that all Content included on this Site — including the information, data, software, photographs, graphs, video, typefaces, graphics, music, sounds, images, illustrations, maps, designs, icons, written and other material and compilations — are intellectual property and copyrighted works of Hutchison Travel Limited and/or various third-party Providers. Reproductions or storage of information or works retrieved from this Site, in all forms, media and technologies now existing or hereafter developed, is subject to the Copyright Ordinance (Cap. 528).

You may use the materials on this Site only for your personal, non-commercial use. Acceptable use

This Site is intended for personal, non-commercial use. You may use this Site only to make legitimate Requests to purchase the products or services offered. You shall not use this Site to make any speculative, false or fraudulent Requests or any Requests in anticipation of demand. You represent that you are of sufficient legal age to create binding legal obligations for any liability you may incur as a result of your use of this Site. You agree to provide correct and true information in connection with your use of this Site and you agree to promptly update your membership information (if applicable) in order to keep it current, complete and accurate.

Without prejudice to any other remedies available, Hutchison Travel Limited reserves its right to suspend or terminate your account if you place a Request in a false name or with an invalid credit card. It is a violation of law to place a Request in a false name or with an invalid method of payment. Please be aware that even if you do not give us your real name, your web browser transmits a unique Internet address to us that can be used by law enforcement officials to identify you. Fraudulent users will be reported to the police and prosecuted to the fullest extent of the law.

Hutchison Travel Limited reserves the right to cancel any airline, hotel reservation or any other transaction that it reasonably believes to have been fraudulently made including, by unauthorized use of a credit or debit card.

No warranties

Unless a Provider has agreed otherwise, all products, services, advice, merchandise and information available through this Site are provided on an "as is," "as available" basis without warranties of any kind, either expressed or implied. These include, but are not limited to, warranties of title or implied warranties of merchantability or fitness for a particular purpose. Without limiting the above, no warranty or guarantee is made:

Regarding the acceptance of any Request;
That a User will receive the lowest available price for goods and/or services available through this Site;
Regarding the availability of products and/or services through this Site or, where applicable, at any participating retailer or retail location;
That use of this Site and all software, products or services associated with this Site will be error free;
Regarding the results that may be obtained from the use of this Site;
Regarding the completeness, accuracy, reliability or quality of any information, content, data, service, advice or merchandise provided or available through this Site; or
Regarding the performance or non-performance of this Site. You expressly agree that the use of this Site is at your own risk.

General limitation of liability

In no event shall PrimeCredit Limited and Hutchison Travel Limited, including its respective officers, directors, employees, representatives, affiliates (including, but not limited to Travel Platform) or providers (collectively, the Covered Parties), be liable for any injury, death, loss, claim, act of god, accident, delay, or any special, exemplary, punitive, incidental or consequential damages of any kind — whether based in contract, tort or otherwise — which arise out of or are in any way connected with any use of this Site, or with any delay or inability to use this Site, or for any information, software, products or services obtained through this Site, even if the Covered Parties have been advised of the possibility of such damages.

Further, the Covered Parties accept no responsibility for any damage and/or delay due to Provider cancellations, shortages, sickness, labor disputes, machinery breakdown, quarantine, government restraints, weather, fire, accidents, earthquakes, riots, strikes, wars, storms, acts of god or causes beyond the Covered Parties' control. No responsibility is accepted for any additional expense, omissions, delays, re-routing or acts of any government authority. No Covered Party shall be responsible for any Provider's breach of any warranty including, but not limited to, implied warranties of fitness for a particular purpose or of merchantability. Nor shall any Covered Party be responsible for any other wrongdoing of a Provider (including any liability in tort) as to any products and/or services available through this Site. No Covered Party shall be responsible for any Provider's failure to comply with these Terms and Conditions, nor for any Provider's failure to comply with applicable laws including, without limitation, laws governing the sale, warranty and return of perishables.

If, notwithstanding the above, a Covered Party is found liable for any loss or damage relating to the use of this Site, the User agrees that the liability of any such party shall in no event exceed the fee or charge to the User assessed by Hutchison Travel Limited for making a Request.

Third parties

If you use this Site to submit Requests for or on behalf of a Third Party, you are responsible for any error in the accuracy of information provided in connection with such use. In addition, you must inform the Third Party of all Terms and Conditions applicable to all products or services acquired through this Site, including all rules and restrictions applicable thereto.

Each User using this Site for or on behalf of a Third Party agrees to indemnify and hold each Covered Party harmless from and against any and all liabilities, losses, damages, suits and claims (including the costs of defense), relating to the Third Party's or the User's failure to fulfill any obligations as described above. The User is directly responsible for any Request submitted, including related fees, charges and performance obligations.

Third party travel service providers

You may be bound by terms and conditions imposed by the travel service providers for whom Hutchison Travel Limited acts as an agent including conditions of carriage, refund and cancellation policies of airlines, cruise lines, car hire operators, hotels, etc.

Hutchison Travel Limited is not liable for any claims against non-fulfillment or unsatisfactory fulfillment of products and services purchased on your behalf by Hutchison Travel Limited from these third party providers and distributors, such as, but not limited to, airlines, hotels, tour operators, car hire companies, insurance companies, and other entities. At times, airlines and other travel services providers may overbook passengers on their flights or re-schedule flight times – Hutchison Travel Limited is not responsible for any such incidents.

User comments, feedback and other submissions

All comments, feedback, suggestions and ideas disclosed, submitted or offered to a Covered Party in connection with your use of this Site (collectively, Comments), shall be and remain the exclusive property of Hutchison Travel Limited and may be used by a Covered Party in any medium and for any purpose worldwide without obtaining your specific consent. For example, your Comments could be used on this Site and in radio, television and print advertisements. Your given name and first initial of your family name may be used with any Comments you submit. No Covered Party is under any obligation to maintain your Comments (and the use of your given name and first initial of your family name with any comments) in confidence, to pay to you any compensation for any Comments submitted, or to respond to any of your Comments. You agree you will be solely responsible for the content of any Comments you make.

Response to Requests

While Hutchison Travel Limited will use its good faith efforts to respond to Requests within the time periods indicated on this Site, no guarantee is made that the status of your Request will be made available to you within the stated processing time. Neither Hutchison Travel Limited nor its Travel Service Providers are responsible for any errors or delays in responding to a Request including, without limitation, error or delays in responding to a Request caused by an incorrect e-mail address or other data provided by you or other technical problems beyond their control.

Links to Other Web Sites and Services

To the extent this Site contains links to outside services and resources, or to the extent that third party websites link to this Site, any concerns regarding such services or resources should be directed to the particular outside service or resource provider. Hutchison Travel Limited does not monitor or control the linked sites and makes no representations regarding, and is not liable or responsible for the accuracy, completeness, timeliness, reliability, or availability of any of the content uploaded, displayed, or distributed, or products or services available at these sites. If you choose to access any third-party site, you do so at your own risk. The presence of a link to a third-party site does not constitute or imply Hutchison Travel Limited endorsement, sponsorship, or recommendation of the third-party, or of the content, products or services contained on, or available through, any such third-party site.

Termination of usage

User access to all or part of this Site may be terminated or suspended at any time, and without notice for any reason.

Pricing Errors

Hutchison Travel Limited endeavors to publish and maintain accurate prices and information for the services we offer. Our suppliers provide us with the price and other information related to these services.

In the event, however, that a service is listed or provided to us at an incorrect price or with incorrect information due to incorrect service information received from our suppliers, typographical error or system error or other error in pricing, we retain the right to refuse or cancel any orders placed for such service.

We shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and/or your credit card charged. If your credit card has already been charged for the purchase and your order is canceled because of incorrect supplier information, we will promptly issue a credit to your credit card account in the amount of the charge. Prices, rates and inventory are subject to availability from the Travel Service Provider.

Credit card submissions

All Requests must be submitted with a PrimeCredit credit card on Travel Platform.

Miscellaneous

These Terms of Use shall be construed, interpreted and performed exclusively according to the laws of Hong Kong, without giving effect to any principles of conflicts of law. You expressly agree that any action at law or in equity arising out of or directly or indirectly relating to these Terms of Use or this Site shall be filed only in the courts sitting in Hong Kong. You hereby consent and submit to personal jurisdiction of such courts for the purposes of any action related to the Travel Platform and this Site, your access or use thereof, or these Terms of Use, and to extra-territorial service of process.

Content and software from the Travel Platform and this Site may be subject to Hong Kong export jurisdiction and the import jurisdiction of other countries. In connection with your use of this Site, you are solely responsible for complying with all applicable export, re-export, and import control laws and regulations of all applicable jurisdictions, including, but not limited to, export and import control laws and regulations of Hong Kong and any other countries. You may not, directly or indirectly, use, distribute, transfer or transmit content or software from this Travel Platform and this Site, whether by way of a direct product or of such materials or products, software, or other technical information into which content or software from this Travel Platform and this Site has been incorporated, except in compliance with all applicable export and import laws and regulations of all relevant jurisdictions.

These Terms of Use may not be assigned by you. Hutchison Travel Limited may assign its rights and obligations set forth in these Terms of Use at any time. Should any part or provision of these Terms of Use be held unlawful, void, invalid or unenforceable, that portion shall be deemed severable from these Terms of Use and shall not affect the validity and enforceability of any remaining provisions. Except as provided herein, these Terms of Use constitute the entire agreement between you and Hutchison Travel Limited pertaining to their subject matter. Certain provisions of these Terms of Use may be superseded or added to by designated legal notices or terms located on particular pages, applications, tools or other materials that you may access within this Travel Platform and this Site. Hutchison Travel Limited’s failure to enforce any provision of these Terms of Use or any additional terms shall not be deemed a waiver of such provisions nor of its right to enforce such provision. These Terms of Use and any related documents may be accepted in electronic form (e.g., by an electronic or other means of demonstrating assent) and your acceptance will be deemed binding between you and Hutchison Travel Limited. You hereby agree, without limitation, that you not will contest the validity or enforceability of these Terms of Use and any related documents.
